Bethany is an attorney in the firm's Commercial Litigation practice group. She handles all phases of litigation, including trial and appeals, in both state and federal court. Her practice focuses on commercial litigation matters, including contract disputes, breach of fiduciary duty claims, tortious interference and business conspiracy claims, trade secret misappropriation, defamation, and land use litigation.

Experience

  • Successfully challenged denial of a conditional use permit application under the Telecommunications Act of 1996 and state zoning laws, resulting in summary judgment in favor of the client.   
  • Represents clients in cases involving litigation over land use permits sought by or granted to the client.    
  • Lead counsel in a variety of trust and estate matters, including cases seeking aid and direction for a trustee, amendments to trust instruments, and approval of nonjudicial settlement agreements.
  • Lead counsel in multiple breach of contract cases brought against companies by customers.
  • Represents media clients in defamation cases and other First Amendment disputes, including access to court proceedings, appeals of orders denying access to court proceedings or records, and obtaining court orders dissolving prior restraints on publication.
  • Represented government contracting company along with co-counsel in case against former employees for trade secret misappropriation, breach of fiduciary duty, tortious interference with business expectancies, violations of the Virginia Computer Crimes Act, fraud, and statutory business conspiracy.
  • Successfully defended a challenge to the enforceability of the restrictive covenants that the client was suing to enforce against the prior owner of the business, resulting in a favorable settlement.
  • Represented local employer defending against tortious interference and conspiracy claims brought by a competitor over the hiring of several of the competitor’s former employees.
  • Counsel for a local government defending against a Fair Housing Act claim over a multi-million dollar redevelopment project.
